In the plastics moulding industry, an OEM files a replevin petition to force a custom moulder to return proprietary injection moulds that are being withheld due to a commercial dispute or unpaid invoices. This judicial action allows the tool owner to obtain a court order for the immediate return of the mould before the final resolution of the dispute.
Court Action
The petitioner must demonstrate to the court that they hold the legal title to the mould and that the moulder has no right to withhold it. Filing this replevin petition requires submitting the original tooling agreement and proof of payment for the mould construction. The court will often require the petitioner to post a bond to cover any potential damages if the seizure is later found to be wrongful.
Tooling Recovery
Obtaining a writ of replevin allows the tool owner to enlist the assistance of local law enforcement to physically retrieve the mould from the factory floor of the moulder.
