This action overrides the buyer’s right to use the tooling until the legal dispute is resolved.
Asset Seizure
Seizing physical property is a final step in the enforcement of a debt. The judicial levy provides a way for a creditor to gain a lien over the moulds even if they are being used for third-party production. This creates a risk for the owner of the tool, who may not be the party responsible for the debt.
Enforcement Action
Official notices and the physical tagging of the equipment mark the beginning of the seizure. Once the judicial levy is in place, the equipment cannot be moved or used without the permission of the court. This can lead to the total loss of production for the duration of the legal process.
The bailiff may physically remove the controller boards or lock the machine to prevent unauthorized operation.
Tooling Risk
Proving ownership of the moulds is necessary to protect assets from being included in a levy against a supplier. A buyer must maintain clear documentation of title and location to ensure that its tooling is exempt from a judicial levy aimed at the moulder’s assets.
