An expedited legal request filed in bankruptcy court compels a debtor to return property belonging to another party. When a custom moulder collapses financially, an emergency turnover motion is filed by the tool owner to recover their proprietary injection moulds. This legal route prevents the tools from being locked in a non-operational plant.
Time Sensitivity
The loss of a mould can stop downstream assembly lines and cause significant financial losses for the brand owner. An emergency motion bypasses the standard multi-week notice period required for typical bankruptcy motions. The tool owner must show that immediate and irreparable harm will occur if the mould is not returned.
This speed is necessary to preserve the supply chain and ensure the continuous assembly of plastic housings.
Evidentiary Proof
To succeed with the motion, the OEM must present clear evidence of tool ownership. This is accomplished by producing purchase orders, tooling agreements, and photographs of the engraved owner nameplate. The debtor cannot retain the tool if the owner has fully paid for its construction.
This proof must be presented clearly to the bankruptcy judge.
Physical Recovery
Upon court approval, the owner can send a logistics team to the moulder’s facility to retrieve the tool. This recovery includes not only the mould itself but also the associated cavity inserts and hot runner controllers. These items are transported to a backup moulder to restart production.
