Meaning
A formal legal request submitted to a bankruptcy court seeks to compel a third party to return property belonging to the debtor’s estate. This request is a turnover motion and is frequently used by a bankrupt customer to force a moulder to surrender custom injection tools or finished plastic parts. It requires the debtor to prove that the property belongs to the estate and is of value to the reorganization.
Legal Trigger
Initiating this court action occurs when a creditor refuses to return assets voluntarily. The debtor files a turnover motion to break the impasse and retrieve the tooling necessary to restart production. This action relies on the court’s authority to enforce the automatic stay.
It represents a direct legal threat to any supplier holding debtor-owned property.
Defensive Position
Responding to this motion requires the moulder to demonstrate a legal right to retain the equipment. The moulder can oppose the turnover motion by asserting a valid moulder statutory lien for unpaid production work. If the moulder can prove the lien is valid and properly perfected under state law, the court will not force the return of the tool without providing adequate protection, such as cash payment.
This defence protects the processor from losing its negotiating power and ensures that the outstanding debts are resolved before the mould leaves the shop.
Asset Recovery
Resolving this dispute often leads to a negotiated settlement that allows the tool to be transferred. Once the court rules on the motion, the parties must comply with the specified terms. This resolution determines where the parts will be manufactured.
