Legal rights that allow plastic processors to retain possession of a customer’s tooling secure the payment of outstanding manufacturing debts. A moulder lien arises by operation of law or by contract when a buyer fails to pay for the plastic components produced by those tools. This lien prevents the buyer from moving the tooling to another supplier until all invoices are cleared.
Legal Leverage
The possession of the injection mould is the moulder’s primary protection against non-paying customers. Since the mould is often the most expensive and time-consuming part of a plastic product launch, withholding it stops the customer’s supply chain. In practice, a moulder lien forces the customer to negotiate or post a bond to recover the tool.
This remedy is particularly effective when dealing with financially distressed OEMs that are attempting to relocate their production lines.
Payment Dispute
The lien can only be claimed for unpaid balances directly related to the production or maintenance of the specific tools being withheld. It cannot be used to secure debts from unrelated transactions.
Sale Proceeding
If the dispute is not resolved, the moulder can initiate a statutory sale of the tooling to recover the debt. This procedure requires formal public notice and an auction process as defined by state or national laws. The proceeds are first applied to the outstanding manufacturing costs and the expenses of the sale, with any remaining funds returned to the tool owner.
