Right to hold the goods remains valid as long as the provider maintains physical control over the asset. This allows the service provider to hold the tool as leverage to ensure they receive the agreed compensation.
The power ends immediately if the asset is voluntarily returned to the owner before the debt is cleared.
Manufacturing Lien
Application of these rules is frequent in the production of complex parts where multiple vendors contribute to the final assembly. A supplier who holds raw material for a customer may use statutory retaining rights to secure payment for previous shipments that are overdue. This creates a powerful incentive for the buyer to stay current with their accounts to avoid a shutdown of their production line.
The law balances the interests of the owner with the rights of the person who has added value to the property.

Specific conditions must be met before this power can be legally enforced. The debt must be directly related to the property being held, and the payment must be officially past its due date.
