In the plastics industry, premature contract termination often occurs when a buyer moves their injection moulding tooling to an alternative supplier before the end of the contracted run. This unexpected end to the supply agreement triggers disputes over unamortised tooling costs, raw material inventory, and minimum purchase commitments.
Contractual Breakdown
Disagreements over mould performance or resin pricing can lead either party to end the manufacturing agreement early. If a moulder fails to meet quality standards or cycle times, the buyer may seek a premature contract termination to protect their supply of plastic parts. The contract must contain clear provisions that define what constitutes a material breach and how much notice must be given before ending the agreement.
Financial Consequence
Sourcing alternative moulding capacity on short notice usually increases the production cost per part. The buyer must also pay for any raw polymer resin that the original moulder purchased specifically for their contract. The moulder may also demand immediate payment for any tooling or modification work that had been amortised over the expected life of the agreement.
Supply Continuity
Transitioning a mould to a new supplier requires careful coordination of the physical tool move. The buyer must ensure that the new moulding shop has the correct machine capacity available to start production. This transfer must be completed quickly.
