This clause governs the distribution of operational risk arising from machine malfunction or material defects.
The protection does not cover incidents resulting from gross negligence or intentional misconduct.
Loss Protection
Component failures caused by hidden resin defects or incorrect customer designs can lead to severe product recalls and financial losses. A hold harmless clause protects the moulding shop from these consequential damages when it processes customer-supplied material. The customer agrees to absorb the costs of lawsuits or property damage linked to the performance of the molded part.
This shift allows the processor to quote lower margins since they do not need to price in catastrophic product liability risks.
Repair Allocation
Injection moulds are expensive capital assets that can suffer damage from fatigue, misuse, or press failures. An explicit hold harmless clause defines who bears the cost of tool repair or replacement during the production run. When the clause protects the moulder, the tool owner must insure the asset against accidents on the factory floor.
This contract prevents the owner from demanding compensation if a high-pressure clamp failure or core pin breakage damages the cavity.
Feedstock Responsibility
Secondary raw materials and recycled resins can cause processing problems or release toxic fumes that damage the injection machinery. Under a hold harmless clause, the party that specifies or supplies the alternative resin assumes the risk of machine wear or chemical degradation. This provision is essential when moulders transition from virgin materials to variable recycled feedstocks to meet environmental goals.
The contract ensures that the financial consequences of a corroded barrel or damaged screw remain with the material specifier.
