Meaning
A financial guarantee required by a judge protects a defendant against potential losses resulting from a temporary judicial order or injunction. Obtaining a court security bond allows a plastics brand owner to secure an order to repossess their injection moulds from a failing supplier while the final ownership lawsuit is resolved. This bond covers any damages the supplier might suffer if the seizure is later found to have been unjustified.
Financial Deposit
The value of the bond is typically set to equal the potential business loss of the manufacturer during the period of the injunction. In the context of custom moulding, the court calculates this based on the value of the active tool, the cost of raw resins, and the projected lost profits of the assembly line. Because high-cavitation moulds can produce millions of parts, this calculation can yield a substantial bond amount that must be secured through a surety company or cash deposit before the sheriff executes the repossession order.
Injunction Liability
If the court later determines that the repossession of the moulding equipment was unwarranted, the supplier can draw upon the bond to recover their losses. This liability makes the brand owner evaluate the strength of their contract before initiating a hasty legal seizure. The bond acts as a risk mitigation tool for both the court and the moulding factory.
Asset Release
Upon a final judgment confirming ownership, the court discharges the bond and releases the collateral. This discharge returns the financial resources to the brand owner. This step concludes the dispute over the mould.
