Security deposits placed with a court during a legal dispute ensure that any eventual judgment can be satisfied. A court escrow bond allows a party to obtain a temporary remedy, such as the release of disputed assets, while the main trial is pending. This mechanism replaces the physical asset with a financial guarantee of equal value.
Financial Deposit
When a plastics moulder refuses to return a customer’s mould due to unpaid invoices, the customer can request the court to release the tool by posting a court escrow bond. The value of this bond is typically set to cover the full amount of the disputed invoice plus estimated legal fees. Once the cash or surety bond is deposited with the court clerk, the judge can order the immediate return of the injection mould.
This arrangement protects the moulder’s financial interest while allowing the customer to continue production at another facility.
Mould Release
The physical release of the tooling prevents extended production shutdowns for the OEM. It shifts the dispute from an operational crisis to a purely financial legal battle.
Risk Mitigation
Using this financial instrument requires the debtor to pay a premium to a surety company, which represents a non-recoverable cost of the litigation. If the court eventually decides in favor of the moulder, the funds are paid out directly from the bond to settle the debt. This structured process prevents unilateral asset seizure and maintains commercial stability during high-stakes moulding disputes.
