Judicial actions allowing a plaintiff to recover personal property that is being wrongfully held by another party are common in manufacturing disputes. Through replevin procedures, an OEM or product brand owner can seek a court order to force a custom moulder to surrender physical possession of their injection moulds. This remedy is typically pursued when a payment dispute has stalled production and the moulder is refusing to release the tool.
Tooling Recovery
Accelerating the recovery of critical assets is the primary goal of this legal mechanism when a supplier relationship breaks down. The customer must file a petition demonstrating ownership of the mould and showing that the moulder’s retention of it is unlawful. If the court agrees, a sheriff or marshal can be dispatched to the moulder’s facility to physically retrieve the tool and return it to the customer.
Secured Bond
Filing a replevin action usually requires the plaintiff to post a substantial bond to protect the defendant against wrongful seizure. This bond must cover the value of the mould and any potential lost profits the moulder might suffer if the seizure is later determined to be unjustified. The financial requirement ensures that the tool is not snatched without a legitimate claim, protecting the moulder’s right to secure payment for completed work before the asset is moved.
In high-value industrial cases, this bond can run into millions of dollars, reflecting the replacement cost of the multi-cavity tooling and the complex hot-runner systems that are critical to the production of high-volume consumer goods.
Commercial Risk
Forced removal of a mould can disrupt a manufacturing run, resulting in defective parts or missed delivery deadlines if the tool is damaged during transit. The process of unmounting a multi-cavity hot-runner tool from an injection press and transporting it to a new facility requires careful handling. Any misalignment or damage during the transition can lead to flashing, short shots, or warped parts, which can delay the start of production at the new moulding plant.
