Meaning
Regulatory exemptions relieve recyclers of the obligation to register substances that have already been registered by an upstream manufacturer or importer. The provisions of reach article 2 7 d allow companies to process plastic waste into new resin without repeating the full chemical safety assessment required for virgin materials. This rule supports the circular economy by reducing the administrative burden on recycling facilities.
Recovery Process
Material must undergo a physical or chemical treatment that results in a substance or mixture that is the same as the original. Washing, grinding and melt filtering are standard steps that satisfy this requirement for most thermoplastic resins. The material must have been legally placed on the market in the region previously.
Chemical Identity
Evidence must show that the recycled plastic contains the same chemical substances as those already listed in an existing registration. This requires a thorough understanding of the additives and pigments used in the source waste. If the recycling process introduces new chemicals, the exemption might fail.
Documentation Requirement
Facilities must maintain records that prove the link between the waste they receive and the registrations held by original producers. Safety data sheets from the virgin material provide the necessary proof of compliance.
