Meaning
A legal application submitted to a bankruptcy court requests permission to take action against a debtor’s property that would otherwise be prohibited by the automatic injunction. Creditors file a motion for relief from stay to recover valuable assets like custom injection moulds or specialized manufacturing equipment from an insolvent customer. This request must demonstrate cause, such as a lack of adequate protection for the creditor’s interest in the property.
Procedural Trigger
Filing this legal request becomes necessary when a customer bankruptcy halts all ongoing tool transfers and payments. The motion for relief from stay asks the judge to bypass the automatic stay so the creditor can reclaim tools or foreclose on a moulder’s lien. Without this court approval, any attempt to seize the equipment is a violation of federal law.
The application represents the primary mechanism for breaking the bankruptcy gridlock and allowing the supplier to secure its physical assets before they are damaged or lost.
Asset Retrieval
Regaining possession of tooling allows a customer to move production to an alternative moulding facility. The motion for relief from stay must prove that the debtor has no equity in the mould and that the mould is not necessary for an effective reorganization. If the debtor cannot run the mould or pay for the resin, the court is highly likely to grant the request.
Litigation Strategy
Navigating this process requires quick action to avoid production downtime. Speed remains necessary because a halted assembly line can cost thousands of dollars per day. Once the judge grants the motion, the creditor can legally retrieve the tool.
